Kirby & Co Realty Group (“Kirby & Co,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains how we collect, use, share, and protect personal information when you visit homesforsaleeasttexas.com (the “Site”) or otherwise interact with our team. We comply with the Texas Data Privacy and Security Act (TDPSA) and related laws governing the personal data of Texas residents.

We collect personal information you provide directly - for example, when you fill out a contact form, request a property valuation, sign up for listing alerts, save a search, or call/text us. This may include:
- Name, email address, phone number
- Property preferences (location, price range, beds/baths, must-haves)
- Buyer/seller status, timeline, financing notes
- Address of a property you’d like us to value
- Messages and notes you send us
We also collect technical information automatically: IP address, browser type and version, device type, pages visited, referring URL, and approximate location derived from IP.
2. How We Use Your Information
- To respond to inquiries and provide real estate services (showings, comparative market analyses, contract management)
- To send listing alerts, property updates, and marketing communications you’ve opted in to
- To operate, secure, and improve the Site
- To comply with TREC, brokerage, and tax recordkeeping requirements
- To exercise legal rights and defend against legal claims
3. Third Parties Who Receive Your Information
We share personal information only with parties that help us run the business, and only as needed:
- IDX Broker / IMPress - powers the live MLS search, property pages, lead capture, and saved-search features. Lead data submitted on the Site flows directly into the IDX Broker CRM.
- Fathom Realty - our supervising brokerage. Transaction-related information is shared with Fathom for compliance and recordkeeping.
- Lenders, inspectors, title companies, and other transaction professionals - only when introduced at your direction in connection with a specific transaction.
- Service providers - email delivery, hosting (Bluehost), analytics, and similar vendors operating under written agreements that limit use of your data to performing services for us.
- Legal authorities - when required by law, court order, or regulatory request (e.g., TREC, IRS).
We do not sell personal information for monetary consideration. We do not knowingly share personal data of consumers under 18 for targeted advertising.
4. Cookies and Similar Technologies
The Site uses essential cookies (for IDX Broker session and saved searches), preference cookies (to remember filters), and - where you consent - analytics cookies. You can control non-essential cookies through our cookie banner and your browser settings. Refusing non-essential cookies will not block your ability to use core search and contact features.
5. Your Rights Under the TDPSA
If you are a Texas resident, you may submit a request for any of the following:
- Right to know: ask us to confirm whether we are processing your personal data and to provide a copy.
- Right to correct: request that we correct inaccurate personal data.
- Right to delete: request that we delete your personal data, subject to TREC and tax recordkeeping obligations.
- Right to portability: receive a copy of your personal data in a portable, readable format.
- Right to opt out: opt out of targeted advertising, sale of personal data (we do not sell), or profiling that produces legal effects.
To submit a request, email privacy@homesforsaleeasttexas.com with the subject line “TDPSA Request.” We will respond within 45 days. If we are unable to verify your identity or honor the request, we will explain why. You also have the right to appeal a denied request - appeals can be sent to the same address with the subject line “TDPSA Appeal.”
6. How We Protect Your Information
The Site uses HTTPS encryption. Lead and CRM data is held in IDX Broker’s hardened infrastructure. We restrict access to personal data to authorized team members on a need-to-know basis and require unique credentials for any system that holds client information.
7. Retention
We keep transactional records for the period required by TREC (currently four years from the closing date) and tax records for the period required by the IRS. Inactive lead records that did not convert to a transaction are reviewed annually and deleted when no longer needed.
8. Children’s Privacy
The Site is not directed at children under 13. We do not knowingly collect personal information from children. If you believe a child has provided us information, contact us at the email above and we will delete it promptly.
9. Changes to This Policy
If we make material changes, we will update the “Last updated” date at the top and, if appropriate, notify you by email. Continued use of the Site after a change constitutes acceptance of the updated policy.
