These Terms of Use govern your access to and use of homesforsaleeasttexas.com (the “Site”), operated by Kirby & Co Realty Group, an East Texas real estate team affiliated with Fathom Realty. By using the Site you agree to these Terms. If you do not agree, do not use the Site.
1. Real Estate Information
The Site displays real estate listings supplied through IDX Broker from participating MLS feeds. Listing information is updated frequently but is provided without warranty of any kind. School district boundaries, square footage, lot dimensions, room counts, taxes, HOA dues, and listing status may change without notice. Always verify any information that matters to you with the listing agent, the seller, the appropriate appraisal district, the school district, and a licensed inspector before relying on it for a buying or selling decision.
2. Fair Housing
Kirby & Co complies with the Fair Housing Act and the Texas Fair Housing Act. We do not discriminate based on race, color, national origin, religion, sex, familial status, disability, or any other class protected by federal or Texas law. If you believe you have experienced housing discrimination, file a complaint with HUD at hud.gov/fairhousing.

The Site is provided for personal, non-commercial use to research East Texas real estate, contact our team, and use the IDX search tools. You may not:
- Scrape, mirror, or systematically extract listing or contact data from the Site.
- Use the Site or its contents to build a competing service.
- Send unsolicited commercial messages to listing agents or our team.
- Attempt to bypass authentication, rate limiting, or other security controls.

Information you submit through contact, valuation, or saved-search forms is handled per our Privacy Policy. Do not send confidential, privileged, or sensitive personal information (Social Security numbers, full bank or routing numbers, ID images) through the Site - use a secure channel we provide during a transaction.
6. Intellectual Property
Site copy, photography, graphics, and code are © Kirby & Co Realty Group except where third-party material is identified. The Kirby & Co and Kirby Custom Homes word marks and logos are used under license. MLS listing data and photos remain the property of the listing brokerage and the contributing agents.
7. Disclaimers
The Site is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.
8. Limitation of Liability
To the fullest extent permitted by law, Kirby & Co Realty Group, Fathom Realty, and our service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site, including damages for lost profits, lost data, or business interruption - even if advised of the possibility of such damages.
9. Governing Law
These Terms are governed by the laws of the State of Texas. Any dispute will be resolved in the state or federal courts located in Smith County, Texas, and you consent to personal jurisdiction there.
10. Changes
We may update these Terms from time to time. Material changes will be posted with a new “Last updated” date. Continued use of the Site after the change constitutes acceptance.
